Our organization is committed to protecting the privacy of our clients and visitors to this site. We do not share protected health information or other non-public information in any unauthorized disclosure. We comply with federal and state privacy regulations as well as the standards and ethics of the National Association of Health Underwriters.

In compliance with Title V of the Gramm-Leach-Billey Act (GLBA) and the laws of the State of California, and in compliance with our obligations to employers and insurers as their business associates, we are providing this notice of our privacy practices to you.

In general, we are prohibited from sharing non-public information about you with a third party without your permission. We must provide you with a reasonably specific notice of the type of information we may collect and the persons and entities to whom that information may be disclosed. We will provide you with a copy of this notice upon request.

Our Obligations

We are required to maintain the privacy of your protected healthcare information, including your personally identifiable health and nonpublic personal information. Our policy is to fully comply with privacy laws regarding all information we create or collect.

Your Rights

You have the right to know how we use and disclose your protected health and identifying information. Certain disclosure is allowable under the law without your permission and your permission is required in other cases. You have a right to request that we restrict our use and disclosure of your personal information. You have the right to personally review your protected health information maintained in our files and to make copies of the same. You also have a right to know the source of this information and the identity of persons or entities to which it was disclosed within 2 years preceding your request. You have a right to request that we correct, amend, or delete any protected information we maintain. Information We Collect

We collect nonpublic personal information about you from the following sources:

  • You or your personal representatives in conversations, correspondence, forms, and applications that you provide or that is provided on your behalf by your representative
  • Information about your transactions with our business associates including insurance companies, administrators, or your employer
  • Information we receive in medical records or from medical professionals that is related to insurance claims

Information We May Disclose to Third Parties

In the course of our ordinary business, we may disclose the information that we collect about you or others without your permission to the following persons or entities for the reasons described as follows:

  • To an insurance company to perform an insurance transaction involving you
  • To an insurance company in order to detect or prevent criminal activity such as fraud or misrepresentation in connection with an insurance transaction
  • To a medical care facility or medical professional in order to verify coverage or benefits or to verify treatment for the purpose of facilitating a claim or authorization
  • To the California Department of Insurance, Department of Managed Care, or other insurance regulatory agency or law enforcement agency or authority in the course of an investigation of alleged or potential fraud or illegal activity and in response to a court order
  • To a group policyholder for the purpose of reporting claims experience or conducting an audit or our operations or services
  • To report suspected or confirmed abuse, neglect or domestic violence to an appropriate governmental authority such as the Dept. of Children's Services.

We may also disclose protected information about you to your family members in emergency situations when such disclosure is directly related to your care or payment of that care.

All other uses and disclosure of your protected health information will only be made with your written permission, which you may revoke at any time.

Our Practices Regarding Confidentiality and Security

Access to nonpublic personal information about you is limited to employees who need to know that information in order to provide products and services to you. We maintain physical, electronic, and procedural safeguards that comply with federal regulations to guard your nonpublic personal information.

Our Policy Regarding Dispute Resolution

Any controversy or claim arising out of or relating to our privacy policy, or the breach thereof, shall be settled by arbitration in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

Reservation of the Right to Disclose Information in Unforeseen Circumstances

Gisske Insurance Services and Teresa Gisske reserve the right to disclose your protected information to our successor in the sale or transfer of our business interests in full or in part, at your direction, the direction of your insurance company or administrator, or on our initiative, provided that successor agrees to comply with this privacy policy.

Complaints

If you have a complaint regarding the maintenance, use, or disclosure of your protected information by our organization you may complain directly to us, or the Secretary of Health and Human Services. Please provide us with a written statement of the details of your complaint and the alleged violation.
